Unfair Dismissal Claims
If you have been with your employer for more than one year, you can bring a claim for unfair dismissal if your employer has dismissed
you from your role without good reason, or they have not dealt with your dismissal fairly.
They must have investigated the matter properly and you informed you of the reasons for your dismissal, you must also have been given the opportunity to explain your version of events.
If this has not happened you may have a claim for unfair dismissal against your employers.
To qualify to bring an unfair dismissal claim in the Employment Tribunal you must meet a number of criteria:
- You must have at least one year's continuous employment
- You must be within the 3 month time limit for bringing a claim to the Employment Tribunal
- You must have been an employee (rather than self-employed or, in most cases, working through an agency)
- You should be aged 65 or below (or the normal retirement age for your occupation)
- Your employment must have been in the UK
Fixed Term Contracts
If you on a fixed term contract that has not been renewed or if your employer has altered your working conditions you may be able to bring a claim for unfair dismissal.
Wrongful Dismissal
If you have been dismissed for gross misconduct (without statutory or contractual notice) you may have an employment tribunal claim for wrongful dismissal.
